Restored by Act of Parliament, 1678
The 1678 Act of Parliament restored the ancient barony to James Tuchet, 3rd Earl of Castlehaven, son of the attainted 2nd Earl. The Act is the governing precedent: individual holders may forfeit; the dignity of the 1313 writ persists as a dormant legal right and can be called back.
Any modern petition must align its pedigree with the continuity this Caroline settlement affirmed. It is not a new creation. It is the old writ, washed of blood.
