Attainted of felony and executed, 1631
Mervyn, 2nd Earl, was tried by his peers, attainted of felony and executed in 1631. The English barony of Audley of Heleigh, being descendible to heirs general and sitting in the English parliament, was forfeit. The Irish earldom, a different creation, was not destroyed in the same way.
This attainder is the wound the 1678 Act will close. A petitioner must know the difference between felony-attainder of an English honour and the survival of an Irish one.
